Client Obligations

Provide the Company with all necessary and requested access to the Client’s books, codes of practice, records, information systems and facilities such that the Company may render the Services. Ensure that sufficient information, instructions and documents are given in due time to enable the required Services to be performed. Procure all necessary access for the Company’s spokeperson to the premises where the assistance are to be completed and take all necessary steps to terminate or remedy any obstacles to, or interruptions in, the performance of the Services. Comply with the Company’s requests to conduct interviews, meetings or discussions with the Client’s Related Third Party, employees and agents on any matters relating to the Services. Supply, if required, any special equipment and personnel necessary for the performance of the Services. Ensure that all the required measures are taken for the safety and security of working conditions, sites, and installations during the performance of the Services.

Limitation Of Liability

The Company shall not be accountable for any partial, delayed, or total non-performance of the Services appearing directly or indirectly from any event outside the Company’s control, including failure by Clients to comply with any of its obligations hereunder. The Company manage to exercise due care and ability in the performance of the Services and undertake responsibility only in cases of proven negligence. Nothing in these Conditions shall prohibit or limit the Company’s liability to the Client for personal injury or death, fraudulent misrepresentation, or any other matter resulting from the Company’s negligence for which it would be illegal to exclude or limit its liability. The Company shall have no responsible for any loss, damage or expense arising from (i) a failure by Client to follow with any of its obligations herein, (ii) any actions taken or not taken based on the Reports and (iii) any incorrect results, Reports arising from unclear, incomplete, misleading or false information provided to us. The Company shall have no responsibility for any incorrect reports of results arising from unclear, incomplete and false information provided to us.
